Rep. Hahn (R) proposes repeal of riparian buffer

Rep. Marcia Hahn (R) from Nazareth has issued a letter of intent to introduce legislation repealing the 150' riparian buffer zone from PA streams.  Please see the attached letter.

SUBJECT: Proposed Legislation
In the near future, I plan to introduce legislation repealing a regulation previously promulgated by the Pennsylvania Department of Environmental Protection (DEP). Specifically, the legislation I am proposing will repeal 25 Pa Code, Section 102.14 relating to riparian buffer requirements. This regulation establishes general requirements for mandatory riparian buffers of 150 feet from waterways designated as high quality or exceptional value waters.
I have learned from a number of businesses and other landowners about the negative impacts this regulation has created regarding the future development of many areas in the Commonwealth. It seems to me that this regulation has resulted in a major shift of state policy, which in effect, amounts to a taking of property without legislative oversight or approval.
