MEMORANDUM

To: All House Members
FROM: Representative Marcia M. Hahn
DATE: October 17, 2011
SUBJECT: Proposed Legislation
In the near future, I plan to introduce legislation repealing a regulation previously promulgated by the Pennsylvania Department of Environmental Protection (DEP). Specifically, the legislation I am proposing will repeal 25 Pa Code, Section 102.14 relating to riparian buffer requirements. This regulation establishes general requirements for mandatory riparian buffers of 150 feet from waterways designated as high quality or exceptional value waters.
I have learned from a number of businesses and other landowners about the negative impacts this regulation has created regarding the future development of many areas in the Commonwealth. It seems to me that this regulation has resulted in a major shift of state policy, which in effect, amounts to a taking of property without legislative oversight or approval.
If you are interested in cosponsoring this legislation, please Contact Gail Pakosky via email or call 717-783-8573.

This would be a huge step back in the preservation on stream quality, not to mention the increased risk off flooding.  Please consider contacting Rep. Hahn to let her know you are concerned about this action.
